Fault and Compensation Under Louisiana Law

Louisiana is a fault state. For accidents governed by the comparative-fault rule effective January 1, 2026, a person who is 51% or more at fault cannot recover damages. When fault is below 51%, the recovery is reduced by that percentage. Different rules may apply to earlier accidents, so the crash date matters. Insurers know this, which is why they work hard to pin fault on victims. Louisiana’s “no pay, no play” law can also substantially limit recovery for an owner or operator who failed to maintain required liability coverage, even when another driver caused the crash.
